Developments in Website and App Accessibility Litigation and Compliance Under the Americans with Disabilities Act

According to the Centers for Disease Control & Prevention (“CDC”), one in four adults in the United States lives with a disability, including those affecting vision, hearing, and mobility.1 With passage of the Americans with Disabilities Act (“ADA”) in 1990, Congress provided “a clear and comprehensive national mandate for the elimination of discrimination against individuals” with such disabilities. 2 Early accessibility challenges under the ADA focused on physical barriers to equal access; yet as more business, commerce, and banking have moved online, website and app accessibility concerns for the disabled population have become much more important.
