The Role of Efficiency Evidence in Pricefixing Litigation

This article argues that defendants’ efficiency evidence will not be enough warrant summary judgment if the plaintiff produces direct or strong circumstantial evidence of agreement, but it may be enough if the plaintiff’s evidence is more ambiguous.
