Arizona
MCLE Rules Changes
The Supreme Court of Arizona has issued an Order extending the deadlines for both the completion of mandatory continuing legal education hours and the required affidavit of compliance, solely for the educational year 2019-2020. The deadline for completion of the necessary hours is extended through December 30, 2020; the deadline for submission of the affidavit of compliance is also extended through December 30, 2020.

British Columbia

Limit on credit hours for recorded programs: No limit. Attorneys can earn all CPD (continuing professional development) hours via recorded programs so long as the program formats have an interactive component, which is defined as 2 or more lawyers listening to or viewing the program together.
Attendance Reporting Procedure: Attorneys must self-report completion of CPD requirements each reporting period through the online Law Society of British Columbia portal. Neither the ABA nor attorneys send certificates of attendance to the Law Society of British Columbia.

California
MCLE Rules Changes
The State Bar of California has issued an order extending the late CLE deadline, which was previously June 30, 2020, to September 30, 2020 for attorneys in Group 3 who have not yet completed their MCLE requirement. Failure to complete the requirement by September 30, and pay any outstanding license fees, will result in being enrolled in Involuntary Inactive status.

Credit hours required: 25 hours per reporting period
Specialty credits required: 4 hours of ethics credit; 1 hour of competency issues credit; and 1 hour of elimination of bias in the profession credit, per reporting period
Length of reporting period: 3 years

Compliance group: California attorney membership is divided into 3 compliance groups by last name: Group 1 (A-G); Group 2 (H-M); and Group 3 (N-Z). Each group is up for compliance every 3 years. Group 1's compliance period is 2/1/16 -1/31/19; Group 2's is 2/1/15 - 1/31/18; and Group 3's is 2/1/17-1/31/20.
Minutes per credit hour: 60 minutes. To calculate credit for a specific program, divide the total length of the program in minutes by 60 and round to the nearest quarter hour.
Limit on credit hours for self-study: Attorneys must earn 12.5 credit hours through activities qualified for participatory credit (or one half of their proportional requirement). The remainder (up to 12.5 hours) can be earned via self-study. ABA On-Demand CLE courses are considered participatory in California. All 25 credit hours may be earned with ABA On-Demand CLE courses.
Attendance Reporting Procedure: Attorneys are responsible for tracking their CLE credit and reporting compliance to the State Bar of California at the end of the reporting period. Prior to the end of the reporting period, the State Bar sends compliance cards to those who must comply that year. Attorneys must retain their certificates of attendance for participatory credit activities. Neither the ABA nor attorneys send certificates of attendance to the California State Bar unless requested during an audit.

Connecticut does not certify courses or providers. Connecticut lawyers are urged to independently review Practice Book §2-27A and make their own determination that a course qualifies for credit towards their MCLE requirement taking into consideration the delivery and content requirements of the rule. If a course has been approved for CLE credit in another jurisdiction, then it automatically meets the content and delivery requirements in Connecticut, subject to the caveat that credit hours are awarded in Connecticut based on “actual instruction time” (e.g., 60 minutes of instruction time equals one credit hour of Connecticut CLE).

Delaware
MCLE Rules Changes
The Supreme Court of Delaware issued an order regarding make-up plans for attorneys who are non-compliant for 2019. The traditional live requirement is waived. In addition, the deadlines have been extended – transcript verification is now due 4/30/2020; completion of the make-up plan is due by 5/31/2020; and reporting of completion is due by 6/15/2020.
The Supreme Court of Delaware also issued an order waiving the live in-person attendance requirement for the two year periods ending December 31, 2020 and December 31, 2021. All 24 credit hours may now be earned with live webinar or on demand programs.

If the program has been directly approved, Florida attorneys must report their completion with the Florida approval code provided on your ABA Cetificate of Completion in the MCLE portal. For programs listed as Self-Apply, Florida attorneys must email or fax their Uniform Certificate of Attendance and their program’s agenda to the Florida Bar in order for their credit to be posted to their CLE total. There is no fee for Florida attorneys to use the reciprocity provision to self-apply.
Approval of ABA Programs
The ABA does not submit individual program applications to the Florida Bar. Florida attorneys may be eligible to receive credit for ABA programs through Florida’s reciprocity provision that allows Florida attorneys who participate in a CLE course or activity that is approved in another mandatory CLE jurisdiction to receive credit. Florida attorneys must email or fax their Uniform Certificate of Attendance and the program’s agenda to the Florida Bar in order for their credit to be posted to their CLE total. There is no fee for Florida attorneys to use the reciprocity provision.

Georgia
MCLE Rules Changes
The Supreme Court of Georgia has issued an order temporarily suspending Regulation 8(e) and (15) to State Bar Rule 8-106(B) which previously limited credit earned through self-study, in-house, or distance learning CLE activities. Effective immediately, attorneys may earn all 12 of their required credits with live webinars or on demand programs. Activities must be completed on or before March 31, 2021.
The Supreme Court of Georgia had previously issued an order temporarily waiving the requirement
that Georgia-licensed attorneys attend 6 hours of in-person CLE. Georgia attorneys may complete all 12 hours of their requirement online though webinars or on demand programming through March 31, 2020. The Georgia Commission on Continuing Lawyers Competency has also extended the late fee deadline to April 30, 2020 for lawyers who have not completed their 2019 CLE requirement.

Attendance Reporting Procedure: Attorneys must self-report CLE compliance on the annual attorney registration statement. Attorneys should not send certificates of attendance to Hawaii after each program.

A Note About MCLE Credit

You can download a copy of the program brochure/agenda from many ABA program websites, or print a copy of the program web page (if no separate brochure available) for submission with your application. There is no fee for Idaho attorneys to seek individual course approval.
Approval of ABA Programs
The ABA does not submit individual program applications to Idaho. Idaho attorneys may individually apply for course approval by submitting the Application for CLE credit to the Idaho State Bar with the required attachments. Illinois
MCLE Rules Changes
The IL Supreme Court will provide attorneys with last names beginning A-M who are in the 2018-2020 reporting period the option to secure a no-cost, three-month extension to complete their credits.
- Attorneys who complete their credits by June 30, 2020 will report compliance at any time by July 31, 2020 at no cost.
- For attorneys who do not complete their credits by June 30, 2020, they will report “Not Yet Complied” to the Board online at www.mcleboard.org by July 31, 2020 to secure the three-month extension at no cost.
- No reason for the extension is needed.
- Those attorneys then have until September 30, 2020 to complete their credits and report compliance to the Board.
MCLE Requirements

Specialty credits required: 6 hours of professional responsibility credit, which must include 4 hours of ethics, 1 hour of diversity and inclusion, and 1 hour of mental illness & substance abuse credit.

The Indiana Supreme Court has waived the credit-hour limitations on distance education courses for attorneys whose three-year Educational Period ends on December 31, 2020. MCLE Rules Changes
The Kansas Supreme Court issued and Administrative Order modifying continuing legal education attendance and reporting deadlines, and waives the limitation on prerecorded programming through September 30, 2020. MCLE Rules Changes
The Louisiana Supreme Court has issued an Order lifting the online MCLE limit from 4 hours to 12.5 hours for the 2020 compliance period ending December 31, 2020. The Louisiana Supreme Court has agreed to suspend the 4-hour limitation on the number of self-study credits for members who are delinquent for the 2019 compliance. Members who are currently delinquent for 2019 may now complete their CLE requirement through unlimited online continuing legal education credits. MCLE Rules Changes
The Maine Supreme Judicial Court issued an Emergency Order suspending the in-person requirement for Maine Bar Rule 5 CLE programs – programs on recognition and avoidance of harassment and discriminatory communication or conduct related to the practice of law. Maine attorneys may now complete this credit with live webinars, but are still not allowed to take the credit with on demand programming.
The Maine Board of the Overseers of the Bar has also extended the 2018/2019 CLE reporting deadline to May 1, 2020. The Board also decided to forgo the imposition of late fees for the 2018/2019 reporting period.

The Minnesota Supreme Court has suspended the 15-hour cap on earning credits with on demand programming for Category 3 lawyers due to report August 31, 2020, for the July 1, 2017 to June 30, 2020 reporting period. While all Minnesota attorneys may complete all 45 credits online with live webinars, attorneys in Category 3 due to report in 2020 may now complete all 45 credits with on demand programs for the current compliance period only.

New Hampshire
MCLE Rules Changes
On May 5, 2020, the NH Supreme Court issued an order regarding filing the NHMCLE Affidavit of Compliance. Active attorneys practicing in the State of New Hampshire must earn 720 minutes of continuing legal education (CLE) that meet New Hampshire Supreme Court Rule 53 criteria by June 30 of each reporting year and file the annual NHMCLE affidavit by July 1 of that reporting year. However, in light of the ongoing COVID-19 pandemic, an attorney who fails to file the certification of NHMCLE compliance on or before July 1, 2020, will receive an automatic extension of time to September 1, 2020, to file that certification, without imposition of a delinquency assessment or fine. In the event that an attorney fails to comply with the extended NHMCLE requirement, a one-time delinquency fee of $300 will be assessed on September 2, 2020. The Supreme Court of New Jersey has issued an order temporarily waiving the requirement that New Jersey-licensed attorneys attend 12 hours of in-person CLE. Attendance Reporting Procedure: In New Jersey, the ABA relies on their reciprocity policies persuant to which our programs are deemed accredited once they are approved by another MCLE jurisdiction. All ABA programs are approved in California, New York, Georgia, Alabama, Illinois, Missouri and many others. New Jersey is a self-reporting state; attorneys certify compliance when required and on forms provided by the New Jersey board. New Jersey attorneys are not required to report individual course attendance as each course is completed, but must retain their certificates of attendance for at least 3 years and must produce them if audited.

New York
MCLE Rules Changes
Effective March 11, 2020, the New York State CLE Board implemented the following policy change: Newly admitted attorneys (those admitted to the New York State Bar for two years or less) may participate in Skills CLE courses in the following live, nontraditional formats, where questions are allowed during the program: (a) webconference; (b) teleconference; and (c) videoconference. This change is effective through June 30, 2020, and should conditions warrant, may be extended. New York General CLE Rules
Credit hours and reporting:
- Credit hours and reporting: Experienced attorneys (admitted to the New York Bar for more than two years) are required to complete 24 credit hours, with at least 4 of the 24 credit hours in the Ethics and Professionalism category and 1 of the remaining credits in Diversity, Inclusion, and Elimination of Bias every two years, reporting within 30 days after the attorney's birthday.
- Minutes per credit hour: 50 minutes. To calculate credit for a specific program, divide the total minutes of instruction by 50 and round down to the nearest half hour.
- Credit requirements and format limitations for newly admitted attorneys: Attorneys who are admitted to the New York state bar two years or less are considered to be newly admitted attorneys and are required to take 16 hours of transitional credit in each of the first two years (3 hours of ethics and professionalism, 6 hours of skills, and 7 hours of law practice management or areas of professional practice each year). Effective January 1, 2016, New York revised its format restriction rules to allow newly admitted attorneys to earn CLE credit for certain categories of transitional credit via approved webinar, teleconference, or on-demand/recorded products, in addition to the traditional live classroom setting or fully interactive videoconference. As of January 1, 2016, newly admitted attorneys also may earn ethics and professionalism credit, law practice management, and areas of professional practice credit through approved webinars or teleconferences, and may also earn credit for law practice management and areas of professional practice through on-demand/recorded products. Skills credit may only be earned through the traditional live classroom setting or through a fully interactive videoconference for newly admitted attorneys. Newly admitted attorneys based in law offices outside of the United States may earn up to 16 credit hours in any approved format; the remaining credit hours must be completed in a format permissible for the credit category. Newly admitted attorneys eligible for a prorated CLE requirement must complete the credit in a format permissible for the credit category, except that no more than 14 credits may be earned through approved on-demand/recorded formats. MCLE Rules Changes
The Ohio Commission on Continuing Legal Education has waived the self-study caps for attorneys and judges with the last names beginning with M-Z to complete the CLE requirements for the 2019-2020 compliance period ending December 31, 2020. Accordingly, attorneys and judges may complete all CLE requirements through approved self-study courses, including live interactive webinars and on demand programs for the compliance period ending December 31, 2020.
The Ohio Commission on Continuing Legal Education has extended the deadline for attorneys with regard to CLE Late Compliance for the 2018/2019 period, with completion now required for all hours by June 29, 2020. MCLE Rules Changes
The South Carolina Appellate Court has waived the restriction that no more than eight credit hours of CLE via online or telephonic course may be earned for the current annual reporting year.
Accordingly, lawyers and judges may earn all or any portion of the CLE credit they are required to obtain for the 2020-2021 annual reporting year (March 1, 2020 – February 28, 2021) through online webinars or on demand programs.

The South Carolina Supreme Court waived the 8 hour cap on distance education, thus permitting attorneys to earn all or any portion of the required annual 14 hours of MCLE credit for the 2019-2020 annual reporting year (ending on February 29, 2020) through pre-approved alternatively delivered programing. Texas
MCLE Rules Changes
Under the Twelfth Emergency Order Regarding the COVID-19 State of Disaster, the Supreme Court of Texas has ordered all deadlines, whether prescribed by statute, rule, or order, that expired or would have expired between March 13, 2020, and June 1, 2020, are extended:
- in attorney professional disciplinary and disability proceedings; and
- relating to the issuance or renewal of certifications, licenses, or registrations issued by the Judicial Branch Certification Commission, or for fulfilling mandatory continuing education.
Deadlines have been extended as follows:
- March will have until May 31, 2020
- April will have until June 30, 2020
- May will have until July 31, 2020
November and December attorneys who are subject to suspension have been extended through June 30, 2020. Attorneys born in January or February will also be granted an automatic 60-day extension, which will prevent further non-compliance fees from being assessed. Any non-compliance fees currently owed will still be due at the end of the extension period. Attorneys born in January and February will have until May 31, 2020, to comply with MCLE requirements.

MCLE Rules Changes
The Supreme Court Board of Continuing Education issued an order suspending all requirements for live in-person attendance to fulfill their MCLE requirements for Utah-licensed attorneys. Utah attorneys may now complete all 24 hours of their requirement online through webinars or on demand programming. The order is effective through June 30, 2020, and applies to attorneys who report in either 2020 or 2021.
The Supreme Court Board of Continuing Education has also extended the compliance and reporting deadline for the compliance year ending in 2020 only. Attorneys complying in June 2020 now have until September 1, 2020 to complete their required hours without paying a late compliance fee, and have until September 15, 2020 to file their Certificate of Compliance reports without paying late filing fees.

West Virginia
MCLE Rules Changes
The Supreme Court of Appeals of West Virginia
has issued an order suspending the live CLE requirement through June 30, 2020. West Virginia attorneys may now complete all 24 hours of their requirement online through webinars or on demand programming.
On Thursday, April 16, 2020 the Court issued a second order extending the general CLE reporting deadline from June 30, 2020 to September 30, 2020, as well as extending the time to complete the Bridge the Gap program, which is mandatory new attorney training. Attorneys admitted between July 1, 2018 and April 30, 2019 now have a one-year extension of the original 24-month requirement for completion. The extension of the Bridge the Gap compliance deadline was due to the live course requirement and the cancellation of the April 2020 training session.
MCLE Requirements
Credit hours required: 24 hours per reporting period
Specialty credits required: 3 hours of legal ethics, office management, substance abuse and/or elimination of bias in the legal profession per reporting period
Length of reporting period: 2 years
Compliance date: June 30 of even-numbered years
Reporting date: July 31 of even-numbered years
Compliance group: All attorneys report biennially.
Minutes per credit hour: 50 minutes. To calculate credit for a specific program, divide the total length of the program in minutes by 50 and round down to the nearest one-hundredth of an hour.
Limit on credit hours for recorded programs:Attorneys can earn up to 12 CLE hours via recorded programs per reporting period.
Attendance Reporting Procedure: The ABA reports attendance to the CLE Commission of the West Virginia State Bar on behalf of all attendees.

MCLE Rules Changes
The Wisconsin Supreme Court has issued an order temporarily suspending the cap on CLE credits earned with on demand programming. The order is effective through December 31, 2020. Wisconsin attorneys may now complete all 30 hours of their requirement online through webinars or on demand programming.

This is the same form that is currently required for attendance reporting. There is no fee for Wyoming attorneys to individually seek Wyoming course approval.
Approval of ABA Programs
Wyoming does not accredit CLE sponsors, only programs. The ABA does not generally submit individual program application to the Wyoming State Bar Association Board of Continuing Legal Education. Wyoming attorneys may individually apply for course approval. Attorneys must submit the same Application for CLE credit (available on website below) that is required for attendance reporting. There is no fee for Wyoming attorneys to individually seek Wyoming course approval.
