In response to a formal request from Vietnam’s Supreme People's Procuracy (SPP) and with the support of the US Department of State Bureau of International Narcotics and Law Enforcement at the US Embassy in Hanoi, the American Bar Association Rule of Law Initiative (ABA ROLI) initiated a comprehensive examination of prosecutorial discretion. The primary objective of this initiative was to aid the Vietnam Supreme People’s Procuracy in identifying and exploring alternative prosecutorial models that can enhance prosecutorial discretion in criminal cases within Vietnam’s justice sector. This request from the SPP is especially timely, aligning with their ongoing review of the 2015 Criminal Procedure Code. Consequently, potential adjustments to the system are actively under consideration and analysis. Expert evaluators are presently scrutinizing the application of prosecutorial discretion in diverse countries, collating their findings into a comprehensive report intended for use by the SPP. The anticipated completion date for this study is March 31, 2024.
