The rule of law stands as a cornerstone of society, providing stability, predictability, and fairness. The American Bar Association (ABA) has adopted a goal to advance the rule of law in the United States and around the world, primarily due to the effort’s normative value. Beyond this intrinsic value of upholding justice and order, the rule of law serves as a catalyst for economic growth and prosperity. For this reason, the ABA Rule of Law Initiative’s mission is to promote justice, human dignity, and economic opportunity through the rule of law—clearly defined as a necessary condition for robust economic development.

Other rule of law champions recognize the economic benefits of rule of law promotion. As noted in its recently released Rule of Law Policy, the United States Agency for International Development “has long championed the rule of law as integral to democracy, human rights, and economic growth, but also as a constituent aspect of the good governance every person deserves.” This blog post delves into the relationship between the rule of law and economic development, highlighting its indispensable role in fostering conducive environments for business, investment, and overall societal advancement.

Instilling Legal Certainty and Business Confidence

At the heart of economic activity lies the need for certainty and predictability. The rule of law ensures that legal frameworks are transparent, consistent, and enforced impartially. In societies where the rule of law prevails, businesses can operate with confidence, knowing that contracts will be upheld, property rights protected, and disputes resolved fairly. This certainty reduces risks for investors and encourages entrepreneurship, leading to vibrant business ecosystems and higher levels of innovation.

This allows resources to be allocated based on merit rather than through political favoritism. This, in turn, promotes sustainable development and reduces inequality, contributing to long-term economic stability.

Beyond its instrumental role in driving economic progress, the rule of law is essential for promoting social cohesion and inclusivity. By ensuring that laws are applied impartially and that all individuals have equal access to justice, the rule of law helps build trust within society and reduces social tensions. Inclusive legal systems empower marginalized groups, including women, minorities, and vulnerable populations, enabling them to participate more fully in economic activities and benefit from the fruits of development.
