Disasters: Thinking About the Unthinkable (CLE)

In the aftermath of the horrible suffering from Katrina, Ike, Sandy, wildfires, tornadoes, and devastation, how can we build a safer, sustainable society with less misery and suffering from foreseeable natural events? This session will discuss why disasters are getting worse and the need for higher building/rebuilding codes and zoning standards; as well as prohibitions on rebuilding, eminent domain, and planning for devastated communities. It will also review post-disaster litigation and litigation around flood control projects, including Arkansas Game and Fish v. United States.

This is the 13th Annual Joint Program of the RPTE Land Use and Zoning Committee and the State and Local Government Land Use Committee. The Supreme Court has granted certiorari in Koontz v. St. Johns River Water Management District, setting the stage for a landmark regulatory takings decision. Our panelists will analyze the Court’s decision and provide insight into the advocates’ strategies.

CFPB and State Attorneys General Compliance (CLE)

With the recent celebration of its first birthday, the CFPB has found its footing. Moving aggressively towards investigative, supervision, and enforcement actions, the CFPB has collected over a half a billion dollars in penalties from numerous financial services companies. The Bureau also is engaging its enforcement arm—state Attorneys General—to wage an aggressive, coordinated, and proactive effort to reform nonbanks in the financial institution space.
