Home Rule Meets State Regulation: Reflections on High-Volume Hydraulic Fracturing for Natural Gas

Hydraulic fracturing, or “fracking,” like all mining, is both a local matter impacting development and environmental quality in its community and a state matter impacting national energy security and regional economic development. Along with the discovery of new sources of natural gas—and methods for its recovery—have come increasing battles over local control and state interests.

The U.S. Supreme Court recently agreed to hear the appeal in United States v. Jones, a case involving the use, by police, of a global positioning system to gather information about a suspect’s movements over an extended period of time.

I think I can speak for everyone who attended: the meeting was a success.

The State and Local Government Law Section will present three continuing legal education programs during the Midyear Meeting in New Orleans.

The Section's Spring Meeting in Washington, D.C., will feature CLEs, substantive committee meetings, outstanding social events, and convene in conjunction with the Public Contract Law Section's State and Local Procurement Symposium.

The Governor’s Council has confirmed Massachusetts Governor Deval Patrick’s nomination of Robert B. Foster as associate justice of the Massachusetts Land Court.

In 1998, the ABA Section of State and Local Government Law was inspired to establish the Jefferson B. Fordham Awards to commemorate the outstanding service of its first Chair, Jefferson B. Fordham, to the advancement of state and local government law and practice, and to honor the accomplishments of practitioners and institutions active in the varied areas of practice associated with state and local government law.
