This article approaches the subject of the legal liability risks of genetically modified organisms, briefly touches upon patent infringement, and expands into other novel forms of tort liability.
Making the Case Against Gene Patents
Drawing largely on the arguments raised in the lower court proceedings of Myriad and Prometheus, this article discusses the policy and legal arguments against the patenting of isolated DNA. Specifically, it describes the detrimental impacts of these patents on research, innovation, and patient care, and explains how these patents violate the Patent Act and the US Constitution.
