Is a manufactured home real property or personal property? The answer may depend on the home’s location. All states except New Hampshire classify manufactured homes as personal property by default. In most states, the owner can choose to reclassify a manufactured home as real property, or as a fixture, but the reclassification process and requirements differ widely from state to state.

The Uniform Manufactured Housing Act (UMHA) brings some clarity to this complex area of property law. Approved by the Uniform Law Commission at its annual meeting in July 2012, the UMHA will be available for state legislatures to consider during the 2013 session.
