Administrative Law


On 1/11/11, the Administrative Conference of the United States announced a proposed rule to identify its procedures for disclosure of records under the Freedom of Information Act (FOIA) and its procedures for protection of privacy and access to individual records under the Privacy Act of 1974. Comments are due 2/10/11. FR1542.



On 1/11/11, the Administration for Children and Families (ACF), Department of Health and Human Services (HHS), announced a request for public comment on a proposed information collection, Statewide Automated Child Welfare Information System (SACWIS) Assessment Review Guide, which provides data to allow ACF to report accurate, meaningful and reliable information to Congress about the extent of problems facing foster care and adoptive children and the effectiveness of assistance provided to this population. Comments are due 3/11/11. FR1619.

On 1/11/11, the Office on Violence Against Women, Department of Justice (DOJ), announced a 1/28/11 meeting of the National Advisory Committee on Violence Against Women (NAC), to introduce federal advisory committee members, receive presentations by DOJ staff on federal efforts to address problems concerning violence against women, and to discuss the goals for the NAC. On 1/11/11, the Office of the Attorney General, DOJ, announced supplemental guidelines for sex offender registration and notification, to augment or modify certain features of The Sex Offender Registration and Notification Act (SORNA) guidelines in order to make a change required by the KIDS Act and to address other issues arising in jurisdictions’ implementation of the SORNA requirements. On 1/11/11, the Office for Victims of Crime announced a request for public comment on an extension of a currently approved information collection, Victims of Crime Act, Victim Compensation Grant Program, State Performance Report, used by state governments to submit annual performance report data about claims for victim compensation. Comments are due 2/10/11. FR1641.



On 1/11/11, the Centers for Medicare and Medicaid Services (CMS), Department of Health and Human Services (HHS), announced a request for public comment regarding a correction of a final rule that corrects several technical and typographical errors in the final rule with comment period that appeared in the 10/29/10 Federal Register entitled ‘‘ Medicare Program; Payment Policies Under the Physician Fee Schedule and Other Revisions to Part B for CY 2011; Final Rule ’’ (75 FR 73170). FR1670.



On 1/11/11, the Federal Emergency Management Agency (FEMA), Department of Homeland Security (DHS), announced final Base Flood Elevations (BFEs) and modified BFEs, which are the basis for the floodplain management measures that each community is required either to adopt or to show evidence of being already in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program. On 1/11/11, the Legal Services Corporation announced the availability of competitive grant funds for the provision of a full range of civil legal services to eligible clients in Louisiana for service area LA–1. Grants will be awarded on or around June 2011. FR1642.


Presidential Action

On 1/7/11, the president signed HR 6523 (P.L. 111-383), the Ike Skelton National Defense Authorization Act for Fiscal Year 2011, to authorize appropriations for fiscal year 2011 for military activities of the Department of Defense, for military construction, and for defense activities of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes.
