On 12/28/10, the United States Parole Commission, Department of Justice (DOJ), announced final rules, effective 1/31/11, to add as criterion for original jurisdiction designation a case in which the offender caused the death of a law enforcement officer while the officer was performing his duty. In the rule on the quorum of Commissioners needed for agency action, the commission is adding provisions that describe the consequence of a vote in which the Commission members are equally divided in their decisions. Presidential Action  
On 12/22/10, the president signed S 4005 (P.L. 111-342), the Preserving Foreign Criminal Assets for Forfeiture Act of 2010, to amend federal forfeiture law regarding the enforcement of a foreign judgment.
On 12/22/10, the president signed S 3998 (P.L.111-341), the Criminal History Background Checks Pilot Extension Act of 2010, to extend the pilot program for volunteer groups to obtain criminal history background checks.

On 11/29/10, the Centers for Medicare and Medicaid Services (CMS), Department of Health and Human Services (HHS), announced a final rule, effective 1/1/11, regarding physician reimbursement for services to include reimbursement for voluntary advance care planning (end-of-life care) to be a part of first and subsequent annual wellness visits. On 12/27/10, the Environmental Protection Agency (EPA), announced an interim final rule, effective immediately, to defer, until 8/31/11, the reporting data elements that are inputs to emission equations under the Mandatory Greenhouse Gas Reporting Rule. FR81338.
On 12/27/10, the EPA announced a request for public comment and call for information to solicit certain additional information pertaining to reporting of inputs to emission equations under the Mandatory Greenhouse Gas Reporting Rule. Information and comments are due 2/25/11. FR81366.
On 12/27/10, the EPA announced a proposed rule to defer the reporting date of certain data elements that are inputs to emission equations under the Mandatory Greenhouse Gas Reporting Rule for three years. Comments are due 1/26/11. FR81350.

On 12/28/10, the Department of Justice (DOJ), Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) , announced a request for public comment on an extension of currently approved information collection, Identification of Explosive Materials, which is a requirement of manufacturers of explosive materials in order to enable law enforcement entities to more effectively trace explosives from the manufacturer through the distribution chain to the end purchaser. On 12/28/10, DOJ, ATF, announced a request for public comment on an extension of a currently approved information collection, Permanent Provisions of the Brady Handgun Violence Prevention Act, to implement the permanent provisions of the Brady Law, which provide for the establishment of a national instant criminal background check system (NICS) that requires a firearms licensee to contact NICS before transferring any firearm to unlicensed individuals. On 1/2/11, the president signed HR 847, the James Zadroga 9/11 Health and Compensation Act of 2010, to amend the Public Health Service Act to extend and improve protections and services to individuals directly impacted by the terrorist attack in New York City on 9/11/01.

On 12/28/10, the Federal Housing Finance Agency adopted a final rule, effective 1/27/11, to implement Section 1116 of the Housing and Economic Recovery Act of 2008 (HERA), to promote diversity and the inclusion of women and minorities in all activities that apply to Fannie Mae and Freddie Mac. On 12/28/10, the Department of Housing and Urban Development announced a request for public comment on a proposed information collection, Economic Opportunity for Low and Very Low-Income Persons, to assess the results of each recipient’s efforts to meet the complaint investigation procedures set forth in Section 3 of the Housing and Urban Development Act of 1968, and to prepare mandatory reports for Congress and the general public assessing the effectiveness of Section 3. On 12/28/10, the Department of Homeland Security (DHS) announced a final rule, effective immediately, to amend its regulations to exempt portions of the ‘‘ Department of Homeland Security/United States Citizenship and Immigration Services–012 Citizenship and Immigration Data Repository System of Records ’’ from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements. On 12/28/10, the U.S. Citizenship and Immigration Services (USCIS), Department of Homeland Security (DHS), announced a request for public comment on a new information collection, E-Verify Program Data Collection, necessary in order for USCIS to obtain data from employers regarding the E-Verify Program. On 12/28/10, the United States Patent and Trademark Office (USPTO), Department of Commerce, announced a request for public comment on a proposal to discontinue its secondary design coding, the practice of coding newly registered trademarks in its searchable electronic database with design mark codes based on the old paper search designations.
