The House Financial Services Committee will mark up several bills, including HR 3126, to establish the Consumer Financial Protection Agency; HR 3818, to amend the Investment Advisers Act of 1940 to require advisers of certain unregistered investment companies to register with and provide information to the Securities and Exchange Commission; HR 3817, to provide the Securities and Exchange Commission with additional authorities to protect investors from violations of the securities laws; and HR --, the Accountability and Transparency in Rating Agencies Act. 10/21/09, 10 am, 2128 Rayburn; 10/22/09, time TBA, 2128 Rayburn.
Criminal Law
On 10/20/09, the National Drug Intelligence Center, Department of Justice, announced a request for public comment on a reinstatement of a previously approved information collection, the National Drug Threat Survey, which provides direct access to detailed drug threat data from state and local law enforcement agencies. Presidential Action  
On 10/15/09, the president issued a proclamation declaring 10/15/09 “White Cane Safety Day,” renewing U.S. commitment to provide full inclusion and equal opportunities for those among us who are blind or have low vision, and calling upon all Americans to observe this day with appropriate ceremonies, activities, and programs.
Election Law
On 10/20/09, the Federal Election Commission (FEC) announced a request for public comment on proposed changes to its rules regarding the definitions of “voter registration activity” and “get-out-the-vote activity” in response to the decision of the U.S. Court of Appeals for the District of Columbia Circuit in Shays v. FEC. Comments are due 11/20/09. FR 53674.

On 10/20/09, the Food and Drug Administration, Department of Health and Human Services, announced a request for public comment on a proposed information collection entitled “Guidance on Informed Consent for In Vitro Diagnostic Device Studies Using Leftover Human Specimens That Are Not Individually Identifiable.” Comments are due 12/21/09. On 10/19/09, the Senate passed S 1793, to amend Title XXVI of the Public Health Service Act to revise and extend the program for providing life-saving care for those with HIV/AIDS.
On 10/20/09, the Office of the Assistant Secretary for Fair Housing and Equal Opportunity, Department of Housing and Urban Development (HUD), announced a request for public comment on a proposed information collection, the Affirmative Fair Housing Marketing Plan, which is used by HUD to assess the adequacy of the applicant’s proposed actions to carry out Affirmative Fair Housing Marketing requirements. Indian Law
The Health Subcommittee, House Energy and Commerce Committee, will hold a hearing on HR 2708, to amend the Indian Health Care Improvement Act to revise and extend that act. 10/20/09, 2 pm, 2318 Rayburn.
The House Natural Resources Committee will hold a hearing on HR 3690, to establish a Commission on Recognition of Indian Tribes to review and act on petitions by Indian groups applying for federal recognition. 10/29/09, 10 am, 1324 Longworth.
International Law  
Presidential Action  
On 10/16/09, the president issued a notice extending for one year the 10/21/95 national emergency with respect to significant narcotics traffickers centered in Colombia. The national emergency has been extended to address the unusual and extraordinary threat to the national security, foreign policy, and economy of the United States constituted by the actions of significant narcotics traffickers centered in Colombia, and the extreme level of violence, corruption, and harm such actions pose in the United States and abroad.
On 10/20/09, the United States Agency for International Development (USAID) announced the availability of the Title II Proposal Guidance and Program Policies Fiscal Year 2010 for review for thirty days. On 10/20/09, USAID announced a 10/13/09 meeting in Des Moines, IA, of the Board for International Food and Agricultural Development (BIFAD) to discuss the BIFAD/USAID Strategic Partnership Memorandum of Understanding, and to hear a progress update on the Africa-United States Higher Education Initiatives and an update on how land-grant universities can contribute to USAID’s agricultural development strategy in Afghanistan, among other matters. On 10/20/09, the Sub-Saharan Africa Advisory Committee, Export-Import Bank of the United States, announced an 11/4/09 meeting in Washington, DC, to hear a presentation on recent developments in sub-Saharan Africa markets, to discuss and receive an update on the 2008 committee recommendations to Congress followed by an update on a new sub-Saharan African special initiative, and to hear an update on the bank’s ongoing business development initiatives.
