The Commercial and Administrative Law Subcommittee and the Courts, the Internet and Intellectual Property Subcommittee, House Judiciary Committee, will hold a joint hearing on HR 4854, to amend the provisions of Title 31, U.S. Code, relating to false claims to clarify and make technical amendments to those provisions. 6/19/08, 10 am, 2141 Rayburn.
Civil Rights/Constitutional Law
SJ Res 40 ( Vitter, R-LA), proposing an amendment to the Constitution of the United States authorizing the Congress and the states to prohibit the act of desecration of the flag of the United States and to set criminal penalties for that act; to Judiciary. S5592, CR 6/12/08.
On 6/12/08, the Senate Judiciary Committee approved the following nominations: Helene N. White and Raymond M. Kethledge , both of Michigan, each to be a United States Circuit Judge for the Sixth Circuit; and Stephen Joseph Murphy III , of Michigan, to be United States District Judge for the Eastern District of Michigan.
The Senate Judiciary Committee will mark up S 2892, to promote the prosecution and enforcement of frauds against the United States by suspending the statute of limitations during times when Congress has authorized the use of military force. 6/19/08, Time TBA, 226 Dirksen.
On 6/13/08, the Bureau of Prisons, Department of Justice, issued a notice that the fee to cover the average cost of incarceration for federal inmates in fiscal year 2007 was $24,922 and the average annual cost to confine an inmate in a Community Corrections Center in fiscal year 2007 was $22,871. On 6/13/08, the Social Security Administration (SSA) issued a notice of proposed rulemaking to clarify that the SSA applies the preponderance of the evidence standard when making determinations and decisions at all levels of the administrative review processes. Comments are due 8/12/08. FR 33745.
The Senate Indian Affairs Committee will hold a hearing on draft legislation that would address problems of law and order in Indian Country. 6/19/08, Time TBA, 562 Dirksen.
The House Financial Services Committee will hold a hearing titled “The 15 th Replenishment of the International Development Association and the 11 th Replenishment of the African Development Fund.” 6/18/08, 10 am, 2128 Rayburn.

The Senate Judiciary Committee will mark up S 1211, to amend the Controlled Substances Act to provide enhanced penalties for marketing controlled substances to minors. 6/19/08, Time TBA, 226 Dirksen.
S 3125 ( Baucus, D-MT), to amend the Internal Revenue Code of 1986 to extend certain expiring provisions, including Section 120 to provide tax-preferred status for group legal services plans; to Finance. S5592, remarks and text S5595, CR 6/12/08.
On 6/12/08, the Senate began consideration of the motion to proceed to consideration of HR 6049, an energy and tax extenders bill that includes a one-year extension of Section 120 to provide tax-preferred status for qualified group legal services plans. A cloture vote is set for 6/16/08.
HR 6261 ( Hill, D-IN), to increase the maximum amount of financial assistance that an individual or household is eligible to receive under the Robert T. Stafford Disaster Relief and Emergency Assistance Act in connection with recent storm damages and flooding in the Midwest; to Transportation and Infrastructure. H5407, CR 6/12/08.
