On 2/9/12, the House passed, by a 417-2 vote, S 2038, as amended, to prohibit members of Congress and employees of Congress from using nonpublic information derived from their official positions for personal benefit.
The Senate Judiciary Committee is scheduled to vote on the following nominations: John Z. Lee, of Illinois, to be United States District Judge for the Northern District of Illinois; John J. On 2/9/12, the Senate Judiciary Committee ordered favorably reported S 1945, to permit the televising of Supreme Court proceedings.
On 2/9/12, the Senate confirmed, by a 90-6 vote, the nomination of Cathy Ann Bencivengo, of California, to be United States District Judge for the Southern District of California.
On 2/9/12, the Senate began consideration of the nomination of Adalberto Jose Jordan, of Florida, to be United States Circuit Judge for the Eleventh Circuit, reaching a unanimous-consent-time agreement providing that the Senate will resume consideration of the nomination at 4:30 pm on 2/13/12 for a cloture vote.
On 2/10/12, the Office of Federal Contract Compliance Programs, Department of Labor, announced a request for comments concerning proposed changes to the affirmative action and nondiscrimination obligations of contractors and subcontractors regarding individuals with disabilities. On 2/10/12, the Patent and Trademark Office (PTO), Department of Commerce (Commerce), announced changes to implement the following provisions as established in the Leahy-Smith America Invents Act: to create a new derivative proceeding to be conducted before the Patent Trial and Appeals Board (PTAB), effective 3/16/13; to create a new inter partes review proceeding to be conducted before the PTAB, effective 9/16/12; and to create a new post-grant review proceeding to be conducted before the PTAB, effective 9/16/12. On 2/10/12, PTO, Commerce, announced a request for comments concerning a proposed new rule to require PTO to issue regulations for determining if a patent is for technological invention in a transitional post-grant review proceeding for covered business method patents.
