Smart Power: Ways to Work Smarter 2009 has brought a new year, a new U.S. president, and a new set of challenges for all of us. Change is the only constant, as unprecedented economic and foreign policy challenges continually emerge, with enormous implications for business operations and the legal profession. At the same time, we are collectively realizing that to meet these challenges, we must work smarter. It’s a time for “smart power,” as we’ve been hearing in the foreign policy context, and that means doing things differently and making full use of the resources available to us.

Cultivating Effective Trade Secret Protection Program The trade secret owner’s obligation to take reasonable measures under the circumstances to protect trade secret information is a crucial element of trade secret law. Because the law is limited in its remedies and is at times inconsistent, the threat of potential legal action is often not enough of a theft deterrent, and litigation is costly and time-consuming, care needs to be taken to ensure that the trade secret protection program designed for a client actually works when implemented. E-Discovery and Digital Evidence Case Digest This decision from Judge Antoon, affirming the report and recommendation of U.S. Magistrate Judge Baker confirms that the duty to cooperate in discovery (including, imo, eDiscovery) extends to Counsel and Client as well between opposing counsel.
