CLE PROPOSALS DUE
JUNE 1, 2010
Here's a good way to spend your holiday weekend: think of some great CLE programs we can consider for the Spring 2011 CLE Conference in Amelia Island, Florida! Then be sure to submit your proposals by June 1, 2010.
The theme for the conference is "Children and Divorce" and CLE programs will focus on how children are affected through the process of divorce. There are the obvious topics of parenting time and support issues, but please feel free to submit proposals that show a detailed analysis of the effects on children of divorce. (Ex. Your trial practice & techniques program might address children talking with the judge in chambers or child abuse issues.)
Our CLE Committee would also like to schedule some ethics-based programs, so if your program hits on ethics, please make sure to send it to us.
We're also accepting proposals for our teleconference series.

Divorce: Taking the "Family" out of the Family Business
This program will focus on the difficulties that arise when spouses who co-own and operate a business decide to divorce. Topics will include authority to make decisions regarding the business while the case is pending, compensation issues, dissipation, and access to business information, as well as the effect of one spouse leaving the business on its value. The panel will also discuss different options for settlement in these particularly difficult cases.

Tech Corner Forget the Fax Machine!
In April 2010, Jim Calloway asked lawyers "Are you still faxing?" It's not clear whether he anticipated that the answer would be a resounding 'yes,' but according to the 2010 ABA Legal Technology Survey Report, while more than two-thirds of respondents (70%) report having electronic fax software available at their firms; only 48% percent of respondents report that they are personally using electronic fax software.
Respondents from firms of 100 or more attorneys are the likeliest users at 67% (up from 59% in the 2009 survey). Surprisingly, solo respondents are the least likely to take advantage of this technology (41% compared with 42% in the 2009 survey).
Perhaps the longevity of faxing technology explains its appeal to lawyers; Robert Ambrogi reported in his chronology of legal technology that fax machines were invented in 1842. Although faxing has a long history, electronic faxing—sometimes referred to as Internet faxing—has an even brighter future as a productivity tool for lawyers.
How electronic faxing works
Electronic faxing is a hosted service. You subscribe to a third-party Internet-based faxing service that converts e-mails to faxes and faxes to e-mails for you. This means that you no longer have to buy and install fax machines, fax servers, modems and special software. Selecting this option includes a number of benefits and costs to take into consideration.
Advantages
* Quality—Send and receive clear and legible electronic files/documents
* Accessible from anywhere with built-in receipt confirmation
* Print only when necessary, not just to send or receive a fax
* No paper jams or 'out of paper' messages
* Paper size doesn't matter. Can send and receive legal-sized documents as easily as letter-sized docs
* Junk faxes can be deleted without ever wasting the paper to print it
* Confidential—no private fax messages sitting out on a public fax machine
* Easier record management, tracking and reporting of activity
* Save the cost of a separate fax line, paper, toner and maintenance expense
* Convenient—receive faxes wherever you can connect to the Internet
* Availability—no busy signals
Disadvantages
* Monthly subscription fees are due and payable whether or not you use all of your incoming or outgoing fax privileges. For high volume offices this may not be an issue.
* Internet access is required. If service is down or inaccessible then you won't be able to send or receive faxes.
* May not be able to get a local number. Ask about the possibility of having your existing fax number transferred to their service; otherwise, confirm with the service that you will have a local fax number. A toll-free fax number may be another available option.
Testing the waters
To get started you need three things; 1) an Internet connection, 2) an e-mail account, and 3) a subscription to an Internet faxing service. As with any hosted service, it's critical to ask potential service providers the right questions in regard to service availability and data security. These services have no activation fees and a free trial period during which you can test drive the service.
