Dear Members,

The year is off to a fantastic start!

It is with a great deal of pride that I announce that 1,500 latest edition law books have been shipped to the University of Liberia and Grimes School of Law in Monrovia, Liberia, thanks to the Section’s contributions of energy and financial assistance to this project. I would like to extend special thanks to Lane Ayres for his great work in making this happen and to all behind this project, including Salli Swartz, Edna Udobong, Victor Mroczka, Marilyn Kaman, Cara Lee Neville, and all members of the subcommittees of the Africa Committee, growing out of the ILEX Africa Delegation to Liberia, Sierra Leone, and Ghana led by past Chair Deborah Enix-Ross in March 2007. Finally, I would like to extend our gratitude to West Publishing and Thomson-Reuters for generously supporting this program.

At the end of August, past Chair Jeff Golden, Vice Chair Salli Swartz, and I attended AIJA’s Annual Congress in Paris.  Other Section (and former AIJA) leaders there included Markus Zwicky, Frans Duynstee, Nicole Van Ranst, Jan Swinnen, Demetrios Eleftheriou, Christian Lundgren, Par Remnelid, Claudio Cocuzza, Malcolm McNeil, Michelle Sindler, Pierre-Yves Gunter, Joren De Wachter, Steven De Schrijver, Dieter Hofmann, Daniel Marugg, Adi Seffer, Duarte de Athayde, Ronald Meissner, Patrick Goudreau, Cristobal Porzio, Ernst Giese, Joaquin Rodriguez Zarza, Joao Traca, Irina Anghel, Sonia Cortes, Sonia Gumpert, Dieter Hoffman, Randall Anderson  — and more.  Led by Europe Committee Co-Chair Christian Lundgren and International Securities and Capital Markets Committee Co-Chair Daniel Bushner, ABA International’s panel on “Securities – U.S. and European Offerings” was of excellent quality and very well attended.  Par and the other AIJA leaders continuously praised the Section, making us feel right at home with this wonderful group of young, mostly European, lawyers.

I am also very proud of the testimonial given by Duarte de Athayde, President of AIJA, about our commemorative book, ABA International, Leading the World’s International Lawyers Since 1878: “it is an outstanding historical record that enriches the legal community!” If you haven’t ordered your copy yet, I hope you will do so soon.  The book not only provides a great background on the history of the Section, it showcases our role in the development of international law for the past 130 years. Click here to read more about the book and order your copy today.

Next stop, The Hague: It’s hard to believe, but our ILEX delegation to the “World’s Courthouse” starts in a few days.

Then, Brussels 2008!  We are expecting more than 650 people from more than 50 countries.  In addition to the 60+ CLE programs split into seven tracks (Competition, Dispute Resolution, Business/Finance/Corporate, Human Rights and the Rule of Law, Public International Law, Trade and Regulatory, and Young Lawyers and Practices of Law), we have a wonderful line-up of world-class speakers that includes Barrister Aitzaz Ahsan, President of the Supreme Court Bar Association of Pakistan; Serge Brammertz, Chief Prosecutor, International Criminal Tribunal for Former Yugoslavia; Hans Corell, former United Nations Under-Secretary-General for Legal Affairs, David Crane, former founding Chief Prosecutor, Special Court for Sierra Leone, 2002–2005; P. Nikiforos Diamandouros, European Ombudsman; Peter Goldsmith, QC, Former Attorney General of England and Wales; C. Boyden Gray, former White House Counsel and US Ambassador to the EU, Peter Hustinx, Supervisor, European Data Protection Agency; Hassan Jallow, Prosecutor of the International Criminal Tribunal for Rwanda; Imran Khan, Chairman of the Pakistan Movement for Justice; Philippe Kirsch, President, International Criminal Court; Robert Petit, Co-Prosecutor, Extraordinary Chambers in the Courts of Cambodia; and Diana Wallis, Vice-President, European Parliament.  Also, our Council Meeting on Saturday morning is open to all members and costs nothing; it’s always an All-Star cast of world leaders in the field of international law.  Join us there.

Our Fall season does not end with the meeting in Brussels.  Some major Section teleconferences are on tap, including “Live at the SEC” and others.  We are also sponsoring events/programs in Buenos Aires and Bucharest in October, and a major celebration in New York of the 60th anniversary of the Universal Declaration of Human Rights (UDHR-NY) in conjunction with the ABA Center for Human Rights and the City Bar of New York, the Paris Bar, and the Italian Bar, with the cooperation of more than 60 bars and international associations of lawyers from around the world. POLICY DEVELOPMENTS

In August, the Sections of International Law and Antitrust Law provided comments to the UK Competition Commission with respect to its Consultation Draft Guidelines on the Application of Divestiture Remedies in Merger Inquiries (“Draft Guidelines”), published in May 2008. The Sections had previously provided detailed views on the Commission’s 2004 Merger Remedies Guidelines (“2004 Guidelines”). While the Draft Guidelines represent an evolution and refinement of the 2004 Guidelines, many of the Sections’ comments on the 2004 Guidelines remain pertinent. The August comments were limited to matters not covered in depth in 2004, except for a few prominent issues that the Sections wished to underscore.

In early September, the Sections of International Law and Antitrust Law offered comments on the amendment proposed by the Israel Antitrust Authority to the Restrictive Trade Practices Law, for the purpose of regulating oligopolies.


MEMBER NEWS

ABA International Council Member at Large and former ABA President Karen J. On November 13–14, the Section of International Law will be marking the anniversary with an important conference to be held in cooperation with the Paris and Italian Bar Associations.
