Utilizing Electronic Discovery in Modern Lawyering

With the onslaught of e-discovery and social media, the sheer volume of information and documentation has presented unprecedented challenges for litigators and the court system. To effectively advocate or defend clients, lawyers need to understand electronic discovery, its inherent implications, how to obtain and retrieve it, as well as its limitations and ethical implications. In this recording, panelists will discuss these issues in addition to employers' necessary consideration of and respect for the First Amendment Rights of their employees, while striking a balance to protect their organization's reputation. Also covered are the ethical implications of lawyers and judges "friending," effectively litigating through the use of e-discovery, and social media issues and considerations in the employment context.
