The civil False Claims Act (FCA) is the fastest growing area of Federal litigation, particularly because of its unique qui tam enforcement mechanism. This will be the first National Institute to bring together experts from all areas – healthcare, defense, environmental, oil and gas, construction, higher education and grant recipients – which have been the subject of qui tam lawsuits seeking treble damages and penalties under this law.

WHAT WILL YOU LEARN?

  • Basics of liability under the FCA
  • Damages and penalties
  • Public disclosure/original source
  • Efforts to amend the FCA
  • Attorneys fees and relator’s share litigation
  • Handling employee discharge cases under Subsection (h)
  • ADR of FCA cases

WHO SHOULD ATTEND?

  • Inside counsel for defense, healthcare, construction, oil and gas companies and every company with Federal government contracts
  • State attorneys general (who have interests both as plaintiffs and as defendants) and Federal & State agency attorneys
  • Criminal white collar defense lawyers, who now must face qui tam relators in virtually every procurement or healthcare fraud investigation
  • Bankruptcy lawyers, who find that the FCA damages and penalties provisions force many defendants into bankruptcy
  • Counsel for public & private colleges and universities and other grant recipients
  • Oil and gas attorneys now facing qui tam royalty suits
  • Housing attorneys who face FCA suits for HUD financing issues

PROGRAM BENEFITS
