In Maples v. Thomas, U.S. Supreme Court rules that death row inmate’s counsel abandonment is cause to excuse procedural default. The Court, citing the Alabama Assessment on the Death Penalty, describes inadequacies of Alabama’s provision of counsel in death penalty cases.
The State Assessments exist to assist states’ understanding of what issues must be examined to determine if a state’s capital punishment system comports with basic due process and minimizes the risk that an innocent person is executed.
