Life After Tuomey: A Stark Reality for Providers

Life After Tuomey: A Stark Reality for Providers

For the second time, a federal district court jury has found that 19 of Tuomey Healthcare System's physician contracts violated the Stark Law. In a verdict returned on May 8, 2013, the second jury also found that Tuomey violated the False Claims Act in its submission of 21,730 claims, and the jury assessed $39,313,605 in damages. The verdict is subject to trebling and per-claim penalties. This important podcast reviews the facts of the case and discusses what the second Tuomey verdict portends for other providers.
