Committee update for RPTE E-Report
The Legal Opinions in Real Estate Transaction Committee sponsored a panel presentation, “The Remedies Opinion and Customary Diligence: The Real Estate Secured Transaction Approach-Is it Consistent With Customary Non-Real Estate Legal Opinion Practice”, at the Fall Joint Meeting in Vancouver. The panelists were Kenneth P. Ezell, Jr., Kenneth M. Jacobson, David L. Miller and Sterling S. Willis.
The Committee has been working on a project to respond to a proposed “Statement on the Role of Customary Practice in the Preparation and Understanding of Third-Party Legal Opinions” that is being advanced by, among others, the ABA’s Business Law Section.
Members of the Committee have been involved in the Working Group on Legal Opinions (WGLO). The WGLO is an endeavor to bring together various legal opinion constituencies to address third-party legal opinion issues and has sponsored programs in October 2006 and April 2007 dealing with legal opinion issues and is sponsoring a third program in October 2007.
