Section Ethics Committees Provide Comments to ABA Commission
The Section appreciates the work of Section members Adam J. Sigman, Patricia H. Char, Dana G. Fitzsimons, Jr., James G. Durham, Louis S. Pettey, and Mike Rubin for their work in providing comments to the ABA’s Commission on Ethics 20/20 regarding domestic and international outsourcing and on Choices of Law in Cross Border Practice.
The ABA Commission on Ethics 20/20 was created by the ABA to perform a thorough review of the ABA Model Rules of Professional Conduct and the U.S. system of lawyer regulation in the context of advances in technology and global legal practice developments. The Commission released a discussion draft paper on outsourcing which asked readers to provide their thoughts on possible amendments to the commentary in the Model Rules of Professional Conduct to give better guidance to lawyers who are involved in outsourcing legal services.
Messrs. Sigman, Durham, Pettey, Rubin, Fitzsimons and Ms. Char reviewed the draft on behalf of the Section and provided the Commission information on several concerns to real property and trust and estate practitioners. Of particular interest to the Commission were the Section’s comments suggesting that amendments to the Black Letter provisions of the Model Rules as well as additions to the Comment may be warranted. The concerns raised by the Section will be reflected in the revised draft to be submitted to the Commission in April.
