Optional Practicum*(additional $40 fee) Buyer and Seller Beware: The When, Where, and What of proper Vender – State Communications (CLE) Saying the right thing at the right time in the right way are the most important rules in any form of communication, but the failure to do any one of those things in communications between vendors and state purchasing officials could have dire consequences for both vendors and state officials. The National Association of State Procurement Officials’ (NASPO) has conducted a survey of its State membership to identify the current status of rules, regulations, and codes of conduct relevant to such communications. In this practicum, NASPO members Gary Lambert and Dean Stotler will present the key findings of that study, inform of the rules applicable to such communications, and offer recommendations so that both side can get the most of the all-important vendor-state communications! Ethics for Government Lawyers: Navigating Recent Developments in Representing Government Entities (CLE) Sponsors: Ethics/Public Contract Law This program will include a panel discussion of ethical issues concerning the recent case of Filarsky v. Delia which is now pending before the United States Supreme Court. The primary issue in the case concerns if and how far immunity applies to a lawyer who is retained by a government entity for the actions of that government entity. The panel will discuss the case and the ethical issues and implications that result. The case raises serious ethical implications for the lawyer, the firm that lawyer works for and the local government that retains the lawyer.
