With the ABA Rule of Law Initiative’s (ABA ROLI’s) support, the Bahraini Ministry of Justice’s Department of Legal Affairs (DLA) published itslegislative drafting guidelines, which will help streamline legislative drafting process in the country.
Mark Segal, an ABA ROLI expert, has been helping the DLA with the effort.Segal made four trips to Bahrain the last in June 2009. Segal’s first twovisits in September and November 2008 involved assessing Bahrain’s legislative drafting capacity. His January 2009 trip focused on improving the drafting andtraining skills of members of the DLA’s Legislative Drafting Working Group andon beginning the drafting process.
The guidelines cover such topics as legislative format and structure, conducting regulatory impact analysis, linguistic clarity and training methods for legislative drafting. The guidelines have been translated into Arabic and reviewed by a local expert.
The DLA is responsible for reviewing all legislation introduced by various Bahraini ministries. In 2010, the DLA plans to begin working to standardize thedrafting process across ministries, including by training legislative drafter sat each ministry on the guidelines.
