Davis Polk wins new trial for Timothy McKinney in Tennessee
The Tennessee Court of Criminal Appeals issued an opinion today setting aside the sentence and conviction of Tennessee Death Row inmate Timothy McKinney. The court found that there was a "reasonable probability that, absent [trial counsel's] deficiencies, the outcome of both the guilt phase and the sentencing phase of the trial would have been different." The court found that those deficiencies "rendered the entire proceeding fundamentally unfair." The Project congratulates Mr. McKinney's post-conviction team at Davis, Polk & Wardwell on their success!
